Payment and refund policy

9.1 In-person orders

For an in-person order, the product is paid for at the premises (1037 Budapest, Kunigunda útja 60.). The Seller issues an invoice and makes it available to the Customer when the product is handed over. The Seller declares that the documents issued to the Customer comply with the applicable legal requirements. The Seller reserves the right to issue an advance payment request in any case. 

9.2 Orders placed in the online shop

Orders placed in the online shop may be paid for by bank transfer, instalments provided by Instacash, bank card or cash on delivery. 

Bank transfer

The Customer may pay the price of the finalised order by bank transfer on the basis of the payment request issued by the Seller, by the deadline stated in it. The Seller fulfils the order and hands the product to the Customer, or to the carrier for delivery, only after the full purchase price has been paid. The order number in the order acceptance confirmation must be included in the transfer reference. The Seller accepts no liability for damage caused by omitting or incorrectly entering the order number; the Customer bears any damage and additional costs. 

Card payment

Online card payments are processed through the Barion system. The merchant does not receive the card details. The service provider, Barion Payment Zrt., is an institution supervised by the Hungarian National Bank; its licence number is H-EN-I-1064/2013. 

Instacash instalment payments

Instacash instalment payment is a simple, premium payment method that helps avoid having to cover a larger expense entirely from one month’s income. Instalment payment is not available for every product!

Cash on delivery

Cash on delivery is paid when the goods are delivered. If this method is selected, the total order amount must be paid to the courier. We charge a fee of 1.990 Ft for cash on delivery. If a cash-on-delivery parcel is returned to us marked “not accepted”, “not collected” or “recipient not found”, we invoice the delivery charge, which is borne by the customer.

Under Hungary’s Act CVIII of 2001, the seller’s online shop software sends the customer an immediate notification that the order has been received. This notification does not constitute a contract between the seller and the customer! It merely indicates that our system has registered the order request and forwarded it to the seller’s responsible employee. If the customer does not receive it within 48 hours, the customer is no longer bound by the offer. The seller allows the customer to withdraw the order electronically until fulfilment begins. When fulfilment begins, the customer is notified by email and/or telephone of the expected fulfilment time and that fulfilment has started. Thereafter, the order can be withdrawn only in person or through one of the contact methods listed under “Contact”. An order may subsequently be amended only in writing, by email.

11.1 Who may exercise the right of withdrawal?

The right of withdrawal may be exercised only by customers who qualify as Consumers under the applicable legislation.
Consumer: a natural person acting outside their trade, independent profession or business activity. Therefore, Bt., Rt., Kft., e.v. and other business forms do not qualify as consumers and have no right of withdrawal. 

11.2 The Customer’s right of withdrawal

It is important to know that the right of withdrawal does not grant additional rights compared with an in-store purchase. The 14-day right of withdrawal is intended to let the Consumer inspect and try the product as they could during an in-store sale. The Consumer must compensate the Business for any loss in value caused by use beyond what is necessary to establish the product’s nature, characteristics and functioning. The Consumer is entitled to withdraw from the purchase without giving a reason within 14 days of receiving the product. The date of receipt is the date the product is collected at the premises or delivered. The withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the Carrier, receives the product. To exercise the right of withdrawal, the Consumer must send an unequivocal statement of the intention to withdraw, by post or electronic mail, to: Tiszta Energiák Kft. 1037 Budapest, Kunigunda útja 60.; email: [email protected]. The withdrawal statement must reach the Seller by midnight on the 14th day after receipt of the product! The statement must include the Consumer’s name and order identifier! If the Consumer decides to withdraw and sends the statement to the Seller, the Seller must acknowledge it within 48 hours of receipt. The ordered product must be returned to the Seller in its original, undamaged condition, complete with all contents, the invoice and the Warranty Certificate. The Consumer bears the costs of returning the product following withdrawal; the Seller does not accept products returned cash on delivery. The Seller refunds the full purchase price only if the product is returned in its original, undamaged condition with all contents. If the returned parcel meets these conditions, the purchase price is refunded using the same payment method within 14 days of the product being received back by the Seller. 

11.3 The Seller’s right to withdraw from the contract

If the Customer does not pay the price of the ordered products by the deadline stated in the payment request or invoice, the Seller may withdraw from the contract. The Seller also has the right to withdraw from the sales contract if the price was displayed incorrectly and the Customer finalised the order at that incorrect price, or if an order was confirmed for an out-of-stock product that the Seller can no longer obtain within a reasonable time. In the event of withdrawal, the Seller sends the statement to the Customer by email, and the Seller’s customer service immediately contacts the Customer to discuss amending the contract, by agreement, to supply another product instead. If the Customer does not accept this, the Seller refunds any amount already paid within 14 days.

11.4 Effects of withdrawal

If the Consumer withdraws from the contract, the Seller refunds all payments made by the Consumer without delay and no later than 14 days after receiving the withdrawal statement, including delivery costs, except additional costs arising because the Consumer selected a delivery method other than the least expensive standard delivery offered by the Seller. The Seller uses the same payment method as in the original transaction unless the Consumer expressly agrees to another method, and neither the Consumer nor the Seller incurs any additional costs because of the refund method. The Seller may withhold the refund until receiving the product and the purchase invoice, or until the Consumer provides evidence of return, whichever occurs first. The Consumer must return or hand over the product and purchase invoice to the Seller without undue delay and no later than 14 days after communicating the withdrawal. The deadline is met if the product and purchase invoice are sent before the 14-day period expires. The Consumer bears the direct cost of returning the product. The Consumer is liable for a reduction in value only if it results from use beyond what is necessary to establish the product’s nature, characteristics and functioning. The Consumer must compensate the Business for such loss in value. The Consumer must exercise the right of withdrawal for its intended purpose and without abuse. In the event of an abusive withdrawal, the Seller is released from the obligation to accept the product back and refund the price. The Seller is obliged to refund the full price only for a returned product that is undamaged, unused or used as intended, has complete packaging and can still be sold as new. The Consumer bears costs arising from damage to the packaging. The Seller is not liable for goods damaged or lost during return transport. If the goods are missing, the Seller has no obligation.
